Kentucky high school drops 'Bible Literacy' course over constitutional concerns

A Kentucky high school will not offer a course on the Bible because of legal concerns over a 2017 law that allows the teaching of such electives in the state's public schools.
The school-based decision making council for Anderson County High School in Lawrenceburg voted unanimously Tuesday to instead offer a "World Religions" course.
The World Religions course will be an optional elective that covers Christianity, Islam, Hinduism and other popular world religions, officials said.

Anderson County High, which began its new school year Thursday, originally planned to offer a "Bible Literacy" course focused on the historical influences of the Old Testament.
But Principal Chris Glass and social studies teacher Corey Sayre — who both serve on the school's eight-member SBDM council that is made up of parents and teachers — expressed concerns over the "vague" standards for the Bible courses that the Kentucky Board of Education approved last year. 
According to The Anderson News, the two also had concerns over the "constitutionality" of the course that was considered after Gov. Matt Bevin signed a bill in 2017 creating regulations for public high schools to offer literature courses on the Bible and Hebrew scriptures.
"I have full confidence in Corey, but I am also worried about the constitutional responsibility that goes with a course like this," Glass said, according to The Anderson News. "I attend church on Sundays but at the same time I understand we have constitutional boundaries. Separation of church and state plays a role in what we do at the school." 
In an email to the Courier Journal on Friday, Glass said "we are extremely busy meeting the needs of our students to start the school year" and that he would not have time to answer questions about the vote.
"I can tell you that I'm extremely proud of my council and the work they do each year for the students and families of ACHS," Glass wrote in the email.

According to The Anderson News, Glass said Sayre had created a curriculum outline for the course this summer, but both decided the class could violate the Establishment Clause of the First Amendment. 
"I've been worried about the constitutionality of it for a while," Sayre said. "It's very difficult to stay in parameters and stay on course and make sure you don't cross constitutional boundaries."
House Bill 128 included language stating that students will be given the opportunity to “explore the Bible’s relevance to contemporary society and culture.”
“Whether you believe that (the Bible is) the word of God or you think it’s complete fiction, you can’t deny the impact it’s had on our culture,” then-Republican state Rep. DJ Johnson said after he co-authored the bill.
When the bill was passed, supporters said the classes would expand students' knowledge of culture, history and society.
The American Civil Liberties Union has criticized the classes, however, as an unconstitutional promotion of Christianity and Sunday school-style "religious life lessons."
The Freedom From Religion Foundation, a Wisconsin-based group that promotes the separation of church and state, also sent letters to Kentucky's public school districts advising them to not offer Bible electives in order to "avoid legal liability" and "to respect students' pluralistic beliefs."
This week the ACLU of Kentucky welcomed Anderson County High's decision to drop the Bible literacy course.
ACLU of Kentucky Legal Director Corey Shapiro said teaching a "comparative religion" class is a better and safer choice for the high school.
"We're obviously glad that they chose to teach a class on world religions that can be done in a secular and objective and non-devotional way," Shapiro said.

In 1963, the U.S. Supreme Court ruled daily Bible readings and prayer in public schools were unconstitutional, but the same ruling allowed religion in public school curriculum.

If a public school chooses to offer courses on the Bible, it should be in the context of a literature course, not a devotional study, according to the Society of Biblical Literature.
The ACLU of Kentucky does not know the exact number of schools in the Bluegrass State that are offering Bible literacy courses, Shapiro said.
In Louisville, Male High School offers the only Bible literacy course in the Jefferson County Public Schools district.
A JCPS spokesman said the course is an elective that has been offered for several years and is sanctioned by the state education department.
Officials at Anderson County High said an undisclosed number of students had signed up for the Old Testament elective before the school decided to not offer it.
Those students can now stay in the new World Religions course or opt out of it, Glass said.
According to The Anderson News, Sayre said during this week's school-based decision making council meeting that he is still developing the curriculum for the new World Religions course but that it will cover "Abrahamic" religions such as Christianity, Judaism and Islam along with Eastern religions.
Sayre added the new course's Christianity portion will not "teach theology" but instead focus on the New Testament and its influence on cultural, political and artistic movements.

The Bible literacy standards approved in June 2018 by the Kentucky Board of Education are separated into three parts — disciplinary literacy, historical thinking and analyzing influences. Here's what's under each:

Determine and analyze the themes, concepts, figures, places and events depicted in biblical texts.
Recognize and analyze various literary forms and genres found in biblical texts.

Analyze the interplay of economic, political, social, geographical, historical, cultural, linguistic and anthropological impacts on the development of biblical texts.
Examine biblical texts considering a variety of textual elements.
Analyze biblical texts, engaging in the skills of sourcing, close reading, contextualizing and comparing.
Compare and contrast various Bible versions to analyze the contextual influences of canons, translations and editions.
Analyzing Influences
Analyze the relationships between the Bible and society and culture.
Examine the influence of the Bible on historical, political and social movements and realities.
Analyze influences of the Bible on the development of religious and secular identities.
Determine the interplay between the Bible and cultural expressions through the examination of a variety of literature, art, language, oratory and music.
